Section I - General
• The artist will not handle the depiction of illegal activities, hateful images, or trademarked characters without permission from the trademark holder. Non-explicit fetish, violence, gore, and humorously offensive work will be considered on a case-by-case basis. The artist reserves the right to reject any commission for any reason.• The artist has the right to blacklist certain clients without providing a public reason.• The artist has the right to change these terms at any time.• The client must read, understand, and agree to all the terms. By continuing with the commission and going forth with the payment, the client has agreed to the above and below terms.• NFTs/AI are not permitted with the Artist's drawings, commissions, or otherwise.
Section II - Payment and Prices
• Prices are subject to change according to the size, complexity, and/or detail of the piece at the discretion of the artist.• Full payment takes place immediately after the artist accepts the commission.• Payments must be made in full within 48 Hours of the invoice before any work is done. The artist does not offer payment plans or holds. Once full payment has cleared, the client's commission will be added to the artist's work queue.• Due dates or rush orders will incur a 50% fee.• A group commission must be paid by 1 (one) person to avoid complications and miscommunications.• Final prices on commissions are non-negotiable.
Section III - Process/Deadline/Communication
• Time of completion can reach up to 2 months (60 days), not including weekends (Friday, Saturday, Sunday). Wait time depends on how full the artist's queue is and what placement you are in the queue. You can see the current queue here: $ https://trello.com/b/sxeUbKzn/comfortkittens-commission-queue$Updates will be sent directly to the client only upon sketch completion, lineart completion, and flat color completion. You may ask for more frequent updates and, Trello will always have current progress posted to it.• The artist may not be available to answer emails/reply on holidays, scheduled days off work, or emergencies. If you do not receive a reply within a few days, I encourage you to resend your message.• Clear and concise visual references and/or descriptions of a commission idea must be provided by the client. After which a preliminary quote will be provided by the artist.• The Artist reserves the right to reject critique and redline pertaining to artistic skill or style preference (i.e. anatomy, coloring style, etc.) or if said critique reduces the artistic quality of the piece.• The artist will not change the character if the commission has already been started.• Quotes may be provided at the client’s request. They do not represent the final price. They are only an estimate at the time of sending and can be changed at any point in the future at the artist’s discretion.• Clients may request changes during the sketching process. Changes applied after this check-in may require an extra fee based on the nature or complexity of the change as the commission will take longer to complete.• If the commission is needed by a specific deadline that is communicated to the artist in advance before starting the commission. The artist may issue a fee depending on the deadline date.
Section IV - Rights
• Commercial use is allowed and will incur a fee.• The client may create prints for personal use (display in their home or as gifts). The client may also resize or crop the artwork to create icons, wallpapers, or other graphics to be used in non-commercial digital format, but the client cannot alter the artwork itself; this includes tracing or copying over the artwork.• The client may upload the artwork to their website or gallery with credit & without prior permission. Uploading the commissioned artwork to Toyhou.se is permitted with credit to the artist’s account (ComfortKitten).• Removing any artist watermarks is a violation of these terms.• The client may not claim the commissioned piece as theirs in any way, shape, or form.• The individual commissioned artwork may not be resold.-To clarify, if selling and/or trading an original character with a piece commissioned from the Artist, the client can add the price of said paid commission to the character’s total value. However, you can't sell the artwork just by itself.• The artist is not responsible for providing the client with a physical object, print, merchandise, etc. of the artwork unless agreed upon in which a fee may be applied.• The artist may recycle sketches and preparatory works that were rejected by the Commissioner for other commissions or personal works.• The artist is not responsible for lost or damaged items sent by mail.
Section V - Refund Policy
• The artist reserves the right to cancel a commission and issue a refund due to poor communication, rude or inappropriate behavior, or inability to communicate in clear/effective English, or unforeseen inability to complete the commission.• The Artist requires 3 days to issue a refund after it has been requested.• Refund policy is as follows; if the client wishes to cancel their commission before work begins, the artist will retain 5% of the original commission payment in US dollars as a convenience fee.• In the event of client cancellation during the sketch/thumbnail stage phase, a 50% refund of the original payment will be issued.• If the artist cancels the commission, 100% of the original commission payment in US dollars will be refunded to the client.• No refund will be issued if the client cancels during the color stage, or after the commission is complete.• In the event that a client is unreachable by ordinary contact means for 3 months or more, the artist reserves the right to cancel the commission and retain a 5% fee. If the client is unreachable for 6 months or more, a refund will not be issued. If the client is unreachable for 1 year or more, then the payment is void.
Section VII - Adoptables / Designs
• Commercial use is allowed and will incur a fee.• All adopts are non-commercial by default. The client may use the character for personal use and the artist must be credited as the creator of the design.• Adoptables may be resold, traded, or vouchered.• Once traded and/or vouchered, they may still be resold.• Adoptables may not be sold for more than they are worth. Adding on the price of commissions that you have paid for is fine.• Adding your own art/drawings you've done of them to their worth is permitted,-If you are seeking commercial usage of a design created by the artist, a commercial fee can be discussed.• Due to many of the Artist's designs are adult/nsfw/fetish themed, when the adoptable is purchased they must be kept an adult and/or 18 and above.• No refunds are provided for adopts. All sales are final.
• No holds.
• No Payment plans.
• Edits to the original adoptable art are allowed.
• Edits not made on the artist’s original art are permitted, feel free to make whatever edits you'd like.
• Upon sale, the full-resolution image will be provided to the client through the platform of the artist’s choice.
• If Creating a twin/minimally edited or any type of Alternative version of an adoptable (whether that be human/feral form, the design as a closed species, or anything else), they must be owned by the same person. When rehoming, they must be sold or traded together. Splits of these alt versions are not permitted.
Section VI - Other
• By providing the client with a line of communication to the artist, the client agrees to act in a professional manner.• The client may not redistribute the artist’s contact (personal emails, phone number, address) in any way unless agreed upon by the artist in advance.• Should any terms of service be breached, or the artist incurs damages caused by the client, the artist reserves the right to either issue a takedown DMCA notice or pursue damages through the Copyright Law of the United States (https://www.copyright.gov/title17/)
